Terms of Business - Recruitment


Standard & Ad Hoc Recruitment

Earl Associates was established to provide a complete recruitment and training package that could be specifically tailored to the individual needs of the user organisation. The recruitment service is essentially assignment based, offering both 'Executive Search' and 'Recruitment Advertising' facilities, in a complete package from job specification through media selection, copy writing, interviewing and short-listing to final selection. The success of the service is based on a thorough understanding of the market sector coupled with a single consultant handling each campaign from inception to completion.

The fees for the standard recruitment service are charged at 22.5% of each successful applicant's total commencing remuneration except that for Senior Appointments, or salaries of £50,000pa. and above, a rate of 30% is applied.

For candidates introduced on an Ad Hoc basis the entire recruitment fee will be payable within twenty-eight days of the each successful applicant's commencement of employment.

For the assignment service this may be applied as a two {or three stage} payment as follows:-

1) One third of the recruitment fee, based on the anticipated annual commencing salary, as a retainer, payable on acceptance  of the campaign together with any agreed advertising.

2) {One third of the anticipated fee on presentation of candidates (shortlist stage)}

3) The balance of the recruitment fee payable on completion of the campaign, and within twenty-eight days of the successful applicant's commencement of employment, together with any agreed expenses.

The Standard Guarantee  

Should any applicant employed through our services leave your employment within eight weeks of the commencement of the said employment, the balance of the recruitment fee will be refundable to your company, subject to the following conditions:-

a)  That the account has been settled within twenty-eight days of the date of the final invoice.

b)  That we are notified in writing within seventy-two hours of the applicant leaving your employment.

c)  That we are given the sole opportunity for one calendar month of re-recruiting for that vacancy.

d) The guarantee will not apply where the circumstances are beyond the control of Earl Associates, such a redundancy, company  re-organisation, bankruptcy, personal injury or death in service.

For candidates placed on an Ad Hoc basis one third of the total recruitment fee will be refundable subject to clauses a), b), c) and d) as above. 

 
Executive Recruitment Service

The Executive Recruitment Service is an assignment service is designed for the recruitment of more senior candidates and offers both 'Executive Search' and 'Executive Selection' facilities, or where appropriate, a hybrid package of both Search & Selection. The success of the service is based on gaining a thorough understanding of the client company's market and building a clear profile of the required candidate. Once the parameters are established the alternatives are discussed with the client and focused into a formal brief for the assignment.

Executive Recruitment - Executive Selection  

Executive Selection is based around recruitment advertising and is advised where there is a large target audience of candidates or where the brief is not focused enough to allow individuals to be targeted effectively.

The fees for the Executive Selection service are charged at 22.5% of each successful applicant's total commencing remuneration up to £49,999pa and at 30% for salaries of £40,000pa. and above. The fees are levied as follows:-.

1) One third of the recruitment fee, based on the anticipated annual commencing salary, as a retainer, payable on agreement of the assignment. 

2) One third of the anticipated fee on presentation of candidates (shortlist stage)

3) The balance of the recruitment fee payable completion of the campaign and the candidate's acceptance of  an offer of employment.

Travel / hotel expenses, medical screening and any other necessary disbursements are rechargeable to the client.

Executive Recruitment - Executive Search  

Executive Search is generally recommended where there is a readily identifiable target group of candidates and where the client wishes to retain confidentiality.

The  fees for the Executive Search service are charged at 25% of the anticipated annual commencing salary and are levied in three stages:-

1) One third of the recruitment fee, based on the anticipated annual commencing salary, as a retainer, payable on agreement of the assignment.

2) One third of the anticipated fee on presentation of candidates (shortlist stage)

3) The balance of the recruitment fee payable completion of the campaign and the candidate's acceptance of  an offer of employment.

Travel / hotel expenses, medical screening and any other necessary disbursements are rechargeable to the client.

The Executive Recruitment Guarantee  

For both Executive Search and Executive Selection, if an appointment is not made following  the shortlist stage, and providing the requirement has not altered, Earl Associates undertake to continue the assignment free of charge until a suitable candidate is found  or the client withdraws the assignment.  In the unlikely event of a candidate leaving the client company within a period of four months Earl Associates undertake to repeat the exercise free of any further charge excepting normal disbursements. In all cases should it be necessary to re-advertise the position the cost will be invoiced to the client.

General Conditions

For the purposes hereof, total commencing remuneration shall mean the basic annual salary together with any additional guaranteed payment, whether expressed as a bonus, commission or otherwise. If a candidate shall be engaged other than as a PAYE employee then the full fee, based on the anticipated salary will be chargeable unless otherwise agreed in advance. No guarantees or refunds will be applicable to non PAYE engagements.

Where a campaign cannot be completed solely due to a change in the client company’s circumstances, or in the event of a client company withdrawing from a campaign where instructions have been taken or once advertising and short-listing have been successfully completed, the outstanding balance of the recruitment fee (based on the original anticipated annual commencing salary) will become immediately payable.

The full fee as set out above is payable by the client to Earl Associates where any applicant is engaged by the client or its subsidiary/associated company as a consequence of, and/or resulting from, the original introduction by Earl Associates to the client. The full fee shall be also payable if such engagement takes place within eighteen months following the date of initial instruction or interview (whichever shall be the later) and whether such engagement results either from a direct or indirect approach by or on behalf of the client or the applicant.

We reserve the right to charge interest at 3% per month (or part of) on any account not paid within our terms of business. Such interest will be calculated from the last day of payment permissible within our terms. On any account not paid within our terms of business we reserve the right to add to the account any costs incurred by us in instructing an agent or solicitor to act on our behalf in the recovery of the said account.
